Affiliate Program Terms and Conditions

Please read these terms carefully before participating in the DDownload Affiliate Program.

These Affiliate Program Terms and Conditions ("Affiliate Terms") govern participation in the ddownload.com Affiliate Program ("Program"). By submitting an application to join the Program, the applicant ("Affiliate" or "Participant") agrees to be bound by these Affiliate Terms in addition to the general Terms of Service and Privacy Policy of ddownload.com.

Important: These Affiliate Terms supplement, and do not replace, the general Terms of Service. In the event of a conflict between these Affiliate Terms and the general Terms of Service, these Affiliate Terms shall prevail with respect to affiliate-related matters.

ddownload.com reserves the right to modify, suspend, or terminate the Affiliate Program at any time, with or without notice, at its sole discretion.

1Definitions

1.1 "Affiliate" refers to a registered user of ddownload.com who has been approved to participate in the Affiliate Program.

1.2 "Commission" refers to the financial compensation earned by an Affiliate through the Program based on legitimate downloads of files uploaded by the Affiliate or sales of premium subscriptions generated through the Affiliate's referral links.

1.3 "Content" refers to any files, data, or materials uploaded, stored, or distributed through ddownload.com by the Affiliate.

1.4 "Referral" refers to a new user who registers on ddownload.com through the Affiliate's unique referral link.

1.5 "Profit Mode" refers to the commission structure selected by the Affiliate, including Pay Per Download (PPD), Pay Per Sale (PPS), or Mixed Mode (MIX).

1.6 "Payout" refers to the disbursement of accumulated commissions to the Affiliate via the selected payment method.

2Eligibility and Application

2.1 To be eligible for the Affiliate Program, the applicant must be at least 18 years of age or the age of legal majority in their jurisdiction of residence, whichever is greater.

2.2 The Affiliate Program is not available to new users by default. Eligible users must submit a formal application through the account dashboard, providing complete and accurate information including but not limited to: website or social media presence, intended use of the program, expected traffic volume, and type of content to be hosted.

2.3 All applications are reviewed manually by the ddownload.com team. ddownload.com reserves the sole and absolute right to approve or reject any application without obligation to provide reasons for rejection.

2.4 Rejected applicants may resubmit an application after a cooldown period of no less than three (3) calendar days from the date of rejection.

2.5 The provision of false, misleading, or incomplete information in the application constitutes grounds for immediate rejection and may result in permanent exclusion from the Program.

2.6 ddownload.com may revoke an Affiliate's approved status at any time if the Affiliate is found to be in violation of these Affiliate Terms, the general Terms of Service, or any applicable laws.

2.7 Each individual may hold only one (1) affiliate account. The creation of multiple accounts for the purpose of circumventing restrictions, generating self-referrals, or any other deceptive purpose is strictly prohibited.

3Permitted Use

3.1 Affiliates may earn commissions through the following legitimate activities:

  • Uploading and sharing original content, open-source software, creative commons media, public domain materials, or other files for which the Affiliate possesses the necessary distribution rights.
  • Referring new users to ddownload.com through personal websites, blogs, forums, social media channels, or other legitimate online platforms.
  • Promoting ddownload.com premium subscriptions through honest, transparent, and non-deceptive marketing practices.

3.2 The Affiliate represents and warrants that it possesses all necessary rights, licenses, and permissions to distribute any content uploaded to ddownload.com and that such distribution does not infringe upon any third-party intellectual property rights.

3.3 The Affiliate shall clearly and conspicuously disclose their affiliate relationship with ddownload.com where required by applicable consumer protection or advertising disclosure laws (e.g., FTC guidelines in the United States, GDPR-related transparency requirements in the European Union).

4Prohibited Activities

4.1 The following activities are strictly prohibited and constitute grounds for immediate termination of affiliate status, forfeiture of all pending and accumulated earnings, and potential legal action:

4.2 Copyright and Intellectual Property Violations

4.2.1 Uploading, distributing, promoting, linking to, or facilitating access to copyrighted material without the express written authorization of the rights holder.

4.2.2 Re-uploading content that has been previously removed due to DMCA takedown requests or other intellectual property complaints.

4.2.3 Using techniques designed to circumvent digital rights management (DRM), content filtering systems, or hash-based duplicate detection mechanisms.

4.2.4 Distributing or promoting software cracks, serial key generators, license bypass tools, or any other tools designed to circumvent software protection.

4.3 Illegal and Harmful Content

4.3.1 Distributing any content that violates applicable laws in any jurisdiction, including but not limited to: malware, ransomware, phishing tools, exploit kits, stolen personal data, identity documents, financial information, or credentials.

4.3.2 Uploading or distributing any form of child sexual abuse material (CSAM). ddownload.com maintains a zero-tolerance policy and will immediately report such content to relevant law enforcement authorities including NCMEC and Interpol.

4.3.3 Distributing content that promotes terrorism, incites violence, or constitutes hate speech as defined by applicable law.

4.3.4 Uploading or promoting adult, pornographic, or sexually explicit material of any kind.

4.4 Fraudulent Traffic and Manipulation

4.4.1 Generating artificial downloads through the use of bots, scripts, automated tools, click farms, traffic exchanges, or any other form of non-organic traffic.

4.4.2 Incentivizing downloads through deceptive means, including but not limited to: locking content behind forced download links (download lockers), requiring downloads as a condition for accessing unrelated content, or offering monetary compensation for downloads.

4.4.3 Creating multiple accounts, using proxy servers, VPNs, or other anonymization tools to circumvent velocity checks, generate self-referrals, or artificially inflate download counts or referral statistics.

4.4.4 Manipulating download statistics through URL redirection chains, iframe embedding, forced redirects, pop-ups/pop-unders, or any technique that initiates downloads without genuine user intent.

4.4.5 Exploiting browser vulnerabilities, cookies, or session data to falsify traffic source or referrer information.

4.5 Spam and Deceptive Marketing

4.5.1 Using unsolicited bulk email (spam), unsolicited direct messages, comment spam, forum spam, or any other mass distribution method that violates applicable anti-spam legislation (e.g., CAN-SPAM Act, GDPR, ePrivacy Directive).

4.5.2 Making false, misleading, or exaggerated claims about ddownload.com's services, features, pricing, download speeds, storage capacity, or earning potential.

4.5.3 Using ddownload.com's name, logo, trademarks, or brand identity in any misleading manner, including but not limited to: paid search advertising on branded keywords, creation of confusingly similar domain names, or impersonation of ddownload.com official communications.

4.5.4 Promoting download links in a manner that disguises the true nature of the content or the destination of the link (e.g., misrepresenting a download as something other than what it actually is).

4.6 Account Abuse

4.6.1 Creating or operating multiple affiliate accounts, whether directly or through third parties, proxies, or automated systems.

4.6.2 Purchasing premium accounts using stolen, fraudulent, or unauthorized payment methods for the purpose of generating affiliate commissions.

4.6.3 Colluding with other Affiliates or third parties to artificially inflate commissions through coordinated downloading, cross-referral schemes, or other manipulative arrangements.

4.6.4 Transferring, selling, leasing, or otherwise assigning affiliate account access to any third party without prior written consent from ddownload.com.

5Commission Structure and Calculation

5.1 Commission rates and payment structures are determined solely by ddownload.com and may be modified at any time with reasonable notice to active Affiliates.

5.2 Available Profit Modes include:

  • PPD (Pay Per Download): Commission based on unique, legitimate downloads of files uploaded by the Affiliate. Rates vary by geographic tier and file size.
  • PPS (Pay Per Sale): Commission based on premium subscription purchases made by users who downloaded files from the Affiliate's account.
  • MIX (Mixed Mode): A combination of PPD and PPS with proportionally adjusted rates for each component.

5.3 Affiliates may change their Profit Mode subject to a minimum interval between changes as determined by ddownload.com. Frequent switching may be restricted to prevent abuse.

5.4 Commissions are calculated exclusively based on verified, legitimate, and organic activity. ddownload.com reserves the right to exclude from commission calculations any activity that it reasonably determines to be fraudulent, artificial, or in violation of these Affiliate Terms.

5.5 ddownload.com reserves the right to adjust commission rates for individual Affiliates based on traffic quality, content compliance record, conversion metrics, and overall program performance.

5.6 Commissions earned from downloads that are subsequently identified as fraudulent or in violation of these terms may be retroactively reversed and deducted from the Affiliate's balance.

6Payments, Minimum Payout, and Tax Obligations

6.1 Payouts are processed upon request by the Affiliate, subject to the minimum payout threshold applicable to the selected payment method. Minimum thresholds vary by payment method and are published in the Affiliate dashboard.

6.2 ddownload.com processes payout requests within a reasonable timeframe, typically within one (1) to fourteen (14) business days, depending on the payment method and verification requirements.

6.3 ddownload.com reserves the right to withhold, delay, or suspend payouts pending review of suspicious activity, compliance verification, or identity verification (KYC) procedures.

6.4 If fraudulent, abusive, or terms-violating activity is detected, all pending and previously accumulated earnings may be forfeited. ddownload.com may also seek recovery of previously disbursed commissions that were earned through prohibited activities.

6.5 The Affiliate is solely responsible for all tax obligations, declarations, and payments arising from affiliate earnings in their jurisdiction of residence. ddownload.com does not withhold taxes on behalf of Affiliates unless required by applicable law.

6.6 ddownload.com may request tax documentation (e.g., W-8BEN, VAT registration number) from Affiliates as required by applicable tax laws before processing payouts.

6.7 Payouts are made exclusively to the payment details registered in the Affiliate's account. The Affiliate is responsible for the accuracy of their payment information. ddownload.com is not liable for payouts sent to incorrect details provided by the Affiliate.

6.8 Mandatory KYC for Payouts: Identity verification (KYC) is mandatory before any payout can be processed. Affiliates must complete KYC verification at least once before their first payout request. ddownload.com will not process any payout to an Affiliate who has not successfully completed identity verification. This requirement applies regardless of the payout amount or payment method selected.

7Content Responsibility and DMCA Compliance

7.1 The Affiliate is solely and fully responsible for all content uploaded, stored, distributed, or promoted through ddownload.com. ddownload.com acts as a hosting provider and does not endorse, verify, or assume liability for user-generated content.

7.2 The Affiliate represents and warrants that all uploaded content is either (a) owned by the Affiliate, (b) licensed to the Affiliate for distribution, or (c) available under an open license (e.g., Creative Commons, GPL, MIT) that permits the intended use.

7.3 ddownload.com complies with the Digital Millennium Copyright Act (DMCA) and equivalent legislation in applicable jurisdictions. Upon receipt of a valid takedown notice, infringing content will be removed promptly.

7.4 Affiliates who receive three (3) or more valid DMCA takedown notices within a twelve (12) month period will be considered repeat infringers. Repeat infringer status results in:

  • Immediate suspension of the affiliate account and all pending payouts.
  • Review of all content uploaded by the Affiliate.
  • Potential permanent termination of the affiliate account and forfeiture of all earnings.

7.5 The Affiliate indemnifies and holds harmless ddownload.com, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to the Affiliate's content or breach of these terms.

8Monitoring, Fraud Detection, and Enforcement

8.1 ddownload.com employs automated fraud detection systems, velocity monitoring, and behavioral analysis to ensure the integrity of the Affiliate Program. These systems monitor, among other things: transaction frequency, IP patterns, download patterns, referral chains, and account creation behavior.

8.2 ddownload.com reserves the right to audit any Affiliate account at any time and to request documentation, evidence, or explanations supporting the legitimacy of the Affiliate's traffic, content, and earnings.

8.3 Failure to cooperate with an audit request within fourteen (14) calendar days may result in suspension of the affiliate account and withholding of all pending payouts.

8.4 ddownload.com may apply a statistical review process ("shaving") to filter out suspected fraudulent or low-quality traffic from commission calculations. The Affiliate acknowledges that not all downloads may qualify for commission payments.

8.5 Violations of these Affiliate Terms may result in one or more of the following actions, at the sole discretion of ddownload.com:

  • Written warning and request for corrective action.
  • Reduction or adjustment of commission rates.
  • Retroactive reversal of commissions earned through prohibited activity.
  • Temporary suspension of the affiliate account.
  • Permanent termination of the affiliate account and forfeiture of all earnings.
  • Reporting to relevant law enforcement authorities where criminal activity is suspected.

9Know Your Customer (KYC) and Identity Verification

9.1 ddownload.com reserves the right to require identity verification (Know Your Customer / KYC) from any Affiliate at any time, including but not limited to the following circumstances:

  • When suspicious or anomalous activity is detected on the Affiliate's account.
  • When cumulative earnings or a single payout request exceeds a threshold determined by ddownload.com.
  • As part of routine compliance checks or regulatory requirements.
  • Upon request from payment processors, financial institutions, or regulatory authorities.
  • When the Affiliate's account data or activity patterns match those of previously terminated accounts.

9.2 KYC documentation may include, but is not limited to:

  • Government-issued photo identification (passport, national ID card, or driver's license).
  • Proof of residential address dated within the last three (3) months (utility bill, bank statement, or government correspondence).
  • Proof of ownership or authorized use of the website(s) or platform(s) listed in the Affiliate's application.
  • Tax identification number or VAT registration number, where applicable.

9.3 The Affiliate must provide the requested KYC documentation within fourteen (14) calendar days of the request. Failure to comply within this timeframe will result in:

  • Immediate suspension of all payout processing.
  • Potential suspension or termination of the affiliate account.
  • Forfeiture of pending and accumulated earnings if the account is terminated.

9.4 All KYC documentation is processed and stored in accordance with ddownload.com's Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR) where applicable.

10Referral Program

10.1 Affiliates may earn referral commissions when a user they referred purchases a premium subscription. The referral is tracked via the Affiliate's unique referral link.

10.2 Self-referrals are strictly prohibited. An Affiliate may not use their own referral link to purchase premium subscriptions for themselves or for accounts they control.

10.3 Referral commissions are calculated as a percentage of the net transaction amount (after payment processor fees) and are subject to the same fraud detection and quality controls as download commissions.

10.4 ddownload.com distinguishes between initial sales and recurring rebills. Different commission rates may apply to each category as published in the Affiliate dashboard.

11Data Protection and Privacy

11.1 The Affiliate acknowledges that ddownload.com collects and processes certain data related to affiliate activity, including but not limited to: download statistics, IP addresses, referral tracking data, transaction records, and device information, for the purposes of program administration, fraud prevention, and compliance.

11.2 The processing of personal data is governed by ddownload.com's Privacy Policy.

11.3 The Affiliate shall not collect, store, or process personal data of ddownload.com users in connection with the Affiliate Program except as expressly permitted by applicable data protection laws.

12Termination

12.1 Either party may terminate the affiliate relationship at any time by providing written notice. The Affiliate may terminate by contacting ddownload.com support.

12.2 Upon voluntary termination by the Affiliate in good standing (no violations of these terms), pending earnings above the applicable minimum payout threshold will be processed within thirty (30) calendar days of termination.

12.3 Upon termination for cause (violation of these Affiliate Terms), all pending and accumulated earnings are forfeited immediately. ddownload.com may also seek recovery of previously disbursed commissions that were earned through prohibited activities.

12.4 Upon termination, the Affiliate shall immediately cease all promotional activities on behalf of ddownload.com and remove any ddownload.com branding, links, or marketing materials from their websites and platforms.

12.5 Sections regarding indemnification, liability limitation, and governing law shall survive termination of the affiliate relationship.

13Limitation of Liability

13.1 ddownload.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to participation in the Affiliate Program, including but not limited to: lost profits, lost data, business interruption, or loss of goodwill.

13.2 The total aggregate liability of ddownload.com to the Affiliate in connection with the Affiliate Program shall not exceed the total amount of commissions earned and paid to the Affiliate during the ninety (90) day period immediately preceding the event giving rise to the claim.

13.3 ddownload.com makes no warranty regarding the expected level of commissions, traffic, or revenue that an Affiliate may earn through the Program.

14Modifications to These Terms

14.1 ddownload.com reserves the right to modify these Affiliate Terms at any time. Material changes will be communicated to active Affiliates via email or through the account dashboard.

14.2 Continued participation in the Affiliate Program after notification of changes constitutes acceptance of the modified terms. If the Affiliate does not agree with the changes, the Affiliate must terminate their participation within thirty (30) days of notification.

15Governing Law and Jurisdiction

15.1 These Affiliate Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

15.2 Any disputes arising from or in connection with these Affiliate Terms shall be subject to the exclusive jurisdiction of the competent courts in Zurich, Switzerland.

15.3 Notwithstanding the foregoing, ddownload.com retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of its intellectual property rights or confidential information.

16Severability

16.1 If any provision of these Affiliate Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic intent and purpose of the invalid provision.
